The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 384, 504, 506, 427 and 326 of the IPC and Section 27 of the Arms Act.

The prosecution case is that the informant loading sand on a truck, in the meantime, 15 to 20 persons including the petitioners came there and assaulted the informant with lathi, Danda and brick and also snatched money, I.D. card, Driving licence, Pan card and Adhar It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.50959 of 2021(2) dt.06-04-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that no specific allegation has been levelled against both the petitioners and there is general and omnibus allegation against them. He further submits that similarly situated co-accused persons have already been granted anticipatory bail by this Court passed in Cr. Misc. No. 44534 of 2021. Petitioners have got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda in connection with Giriyak P.S. Case No. 149 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
