The petitioner apprehends his arrest in Banka P.S. Case No. 545 of 2016, registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code. The informant, Panchayat Secretary, alleged that he handed over the key of Panchayat building to Bengali Mahto. On 13.06.2016 Shekhar Panjiyara asked for the key, but Bengali Mahto refused to hand over the key of the Panchayat building to Shekhar Panjiyara. The informant further alleged that the gate of Panchayat Bhawan was unlocked and some articles were stolen including the register of appointment of Panchayat teachers made in the year 2006.
It is submitted that the name of the petitioner figured in
Patna High Court Cr.Misc. No.39320 of 2016 (2) dt.16-09-2016 2/2 the case on mere suspicion. There is nothing on record to show that the petitioner committed theft in Panchayat Bhawan. Considering the facts aforesaid and the fact that on mere suspicion the name of the petitioner figured in the FIR, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 545 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
