The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420, 466, 468, 471, 193, 209, 167, 170, 219, 120B of the Indian Penal Code.
The prosecution case is that the parents of petitioners got an order in a case under B.T. Act on the basis of compromise by making one Upendra Singh as party respondent fraudulently with regard to a land and thereby claimed possession over the same. From the accusation made in the complaint petitioner it is not clear that how Upendra Singh is related to the informant and how order passed in a proceeding under B. T. Act prejudiced the informant. A statement has been made in paragraph 3 of the petition that the
Patna High Court Cr.Misc. No.35488 of 2015 (3) dt.04-09-2015 2/2 petitioners have no criminal antecedent.
Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sadar P.S. Case No.21 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
