2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.

As per allegation in the FIR, while the informant was driving six wheeler truck on 15.5.2022, at night 12.30 O'clock, one white colour Bolero vehicle came ahead of his vehicle and signaled to stop, then he slowed his vehicle. It is further alleged that 5-6 persons got down from the Bolero and boarded on his truck and sat him down in Bolero after tiding his limbs, eyes and mouth. After 4-5 hours they got him down from Bolero vehicle near forest. They looted his mobile and truck loaded with rod and cash of Rs. 23,000/-.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Neither the petitioner is named in the FIR nor put on TIP. There is no eye witness of the alleged occurrence. Nothing has been recovered from his conscious possession. Similarly situated other co-accused persons have already been granted bail by this Court vide order dated 31.01.2024 passed in Cr. Misc. Nos. 72506 of 2023 and 329 of 2024. Petitioner is languishing in judicial custody since 4.1.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Mahindwara P.S. Case No.80 of 2022.
