The petitioner are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325 and 307 of the Indian Penal Code.
There is omnibus and general accusation against 11 persons including the petitioners to have assaulted the informant but there is specific accusation of assault against petitioners Jamuna Bind, Mukesh Bind and Balister Bind. The
Patna High Court Cr.Misc. No.36725 of 2015 (2) dt.10-09-2015 2/2 informant has received altogether eight injuries, out of eight injuries opinion has been kept reserved with regard to three injuries.
It is submitted by learned counsel for the petitioners that there is a counter version of the occurrence and the accusation has been leveled in the background of land dispute.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Chainpur P.S. Case No. 113 of 2015 pending in the court of learned Chief Judicial Magistrate, Kaimur at Bhabua.
With the aforesaid observation, this application is disposed of.
