This is an application for bail in connection with Harnaut P.S.Case No. 45 of 2017 registered for the offences punishable under Sections 457, 380 and 411 of the Indian Penal Code.

Allegation against the petitioner is that he was arrested at the spot and recovery has been made from him. It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and he is in custody for about five months having clean antecedent. Heard learned APP also.

Having heard both sides and in view of the fact that petitioner was arrested at the spot, I am not inclined to grant bail

Patna High Court Cr.Misc. No.29806 of 2017 (3) dt.19-07-2017 2/2 to the petitioner. Prayer for bail is rejected. However, learned trial court is directed to expedite the trial and try to conclude the same within four months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.

Accordingly, this application is dismissed.
