2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 406, 420, 467, 468, 471/34 of the Indian Penal Code.

3. As per the complaint, the allegation against the petitioner is that in spite of instruction of LRDC that land receipt will not be executed for the ancestral land bearing Khata No. 524, 463, plot no. 1178(N),15625(O) of the complainant but the petitioner executed the land receipt of the aforesaid land.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.44889 of 2023(7) dt.08-02-2024 2/2 case. It is further submitted that there is civil dispute between the parties bearing Title suit no. 279 of 2016 is pending before the court of learned Sub- Judge-I, Gaya. The petitioner has got no criminal antecedent.

5. Learned APP for the State opposed the prayer for bail .

Considering the nature of offence that it is a civil dispute between the parties, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 1807 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
