JUSTICE HEMANT GUPTA) Date: 12-08-2016 Leaned counsel for the appellant wishes to withdraw the present Letters Patent Appeal but with liberty to submit representation to the State Government for pay-fixation in the light of Circular dated 11th of February, 2014 in respect of pay-fixation and 17th of June, 2015 in respect of payment of retiral benefits. Both the Circulars were issued after the learned Single Bench dismissed the writ application filed by the appellant.

Patna High Court LPA No.453 of 2014 dt.12-08-2016 2/2 In view of the prayer made, the Letters Patent Appeal is dismissed as withdrawn with liberty to the appellant to submit representation in respect of pay-fixation and/or pensionary benefits. As and when the representation is submitted, the same shall be considered by the State authorities in accordance with law expeditiously.
