NILU AGRAWAL ORAL ORDER 21-12-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

Petitioners are languishing in judicial custody since 08.06.2016 in connection with Uda-Kishunganj P.S. Case No. 66 of 2016 registered for the offence punishable under Sections 47 (A) and 47(b) of the Bihar Excise (Amendment) Act, 2016. The prosecution case, as lodged by the police personnel, is that during course of checking, house of the petitioners was searched and the petitioners were apprehended with eight litres of Mahua wine and several utensils used for making illegal country made liquor.

It has been submitted by the learned counsel for the petitioners that they are innocent, have no criminal history and

Patna High Court Cr.Misc. No.53330 of 2016 (2) dt.21-12-2016 2/2 have falsely been implicated in the aforesaid case and that chargesheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.

However, learned A.P.P. for the State submits that the petitioners are named in the First Information Report, hence, opposes the prayer for bail.

Be that as it may, since charge-sheet has already been submitted, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Uda-Kishunganj, District Madhepura in connection with Uda-Kishunganj P.S. Case No. 66 of 2016.
