This is an application for bail in connection with Ram Nagar P.S.Case No. 121 of 2005, corresponding to Trial No. 5 of 2017, registered for the offences punishable under Sections 20 and 22 of N.D.P.S. Act.

Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 3.3.2017 passed in Cr.Misc.No. 8104 of 2017 and this application has been filed for bail without any new fact.

It has been submitted on behalf of the petitioner that not a single witness has been examined in this case till date though charges were framed in this case on 18.3.2017. Heard learned APP also.

Patna High Court Cr.Misc. No.34662 of 2017 (2) dt.26-07-2017 2/2 Having heard both sides and considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to conclude the trial within three months, if possible conduct it on day to day basis. If trial is not concluded within the said period, petitioner may renew his prayer for bail. At the same time, Superintendent of Police, West Champaran, Bettiah is directed to ensure the presence of the witnesses in court on the date fixed.

Learned trial court and the Superintendent of Police are directed to submit monthly progress report in this case to this Court and office to place the report when received, under the heading 'For Orders'.

With the above observation, this application is dismissed.
