The petitioner apprehends his arrest in connection with C.I. Case No. 628 of 2018, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 45 bottles each containing 750 ml and 57 bottles each containing 180 ml Indian made foreign liquor from the house of Boby @ Abhijeet Sharma, in which, he used to run the coaching centre. Learned counsel for the petitioner submits that it would appear from the prosecution report that in accused column, name of the petitioner has not been detailed but later on, in supplementary prosecution report, name of petitioner

Patna High Court CR. MISC. No.40538 of 2019(2) dt.02-07-2019 2/2 along with Manish Kumar were added. In fact, petitioner used to visit in the house of co-accused, Boby @ Abhijeet Sharma, who used to run the coaching centre, from where, the aforesaid liquors were seized, due to that reason petitioner has falsely been implicated in this case and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.D.J.-II-cumSpecial Judge, Katihari, in connection with C.I. Case No. 628 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
