26-11-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Katra P.S. Case No. 166 of 2021, registered for the offence under Sections 414, 420, 120(B) / 34 of the Indian Penal Code, Sections 25(1-B)a, 26, 35 of the Arms Act and Section 20 / 22 of the N.D.P.S. Act. As per the prosecution case, this petitioner alongwith co-accused Munna Kumar Singh were apprehended and from the possession of co-accused Munna Kumar Singh one 7.65 bore semi-automatic pistol with five cartrigdges, two 7.65 bore semi automatic pistols, 51 pellets, 500 gms. of Charas, number plate and Rinch have been obtained.

It is submitted on behalf of petitioner that as per F.I.R. itself, no incriminating article has been recovered from the

Patna High Court CR. MISC. No.50631 of 2021(2) dt.26-11-2021 2/2 possession of the petitioner. Petitioner was apprehended alongwith co-accused Munna Kumar Singh, from whose possession, arms and ammunition were recovered. Petitioner is in custody since 10.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Muzaffarpur in connection with Katra P.S. Case No. 166 of 2021.
