JUSTICE BIRENDRA KUMAR ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 341/323/387/307/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 37(c) of the Bihar Excise (Amendment) Act, 2016.

Allegation is that the petitioner demanded ransom from the informant and fired, which caused no injury. Submission of the petitioner is that in fact petitioner has purchased a motorcycle from the informant and the informant had already made over the said motorcycle after receiving consideration money, but the sale papers were not executed. Hence, simple occurrence of altercation had taken place.

Patna High Court Cr.Misc. No.55308 of 2016 (3) dt.13-02-2017 2/2 Petitioner is in custody since 05.11.2016.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria/Successor Court, in connection with Beldaur P.S. Case No. 154 of 2016.
