The petitioner is in custody in connection with Muzaffarpur Sadar P.S. Case No. 156 of 2017 for the offences under Section 414 and 401 of the Indian Penal Code. From perusal of the FIR it appears that on 25th of March, 2017 on the basis of secret information the police rushed to the Rewa Road and arrested two persons, namely, Sujeet Kumar @ Susatiya and Rahul Kumar @ Monu. The aforesaid two persons disclosed the name of their associates including this petitioner involved in theft of motorcycle. Out of the five persons named by the aforesaid Sujeet Kumar and Rahul Kumar one Neeraj Kumar

Patna High Court Cr.Misc. No.27066 of 2017 (2) dt.01-07-2017 2/2 has been granted bail by this Court in Cr. Misc. No. 24234 of 2017; co-accused Rahul Kumar @ Sonu @ Monu has also been granted bail in Cr. Misc. No. 25934 of 2017 vide order dated 15.6.2017 whereas co-accused Sujit Kumar Rai @ Susatiya @ Sujit Kumar, who was arrested on spot was granted bail in Cr. Misc. No. 24234 vide order dated 24.5.2017.

Having regard to the orders passed by this Court in Cr. Misc. No. 25934 and 24234 of 2017 whereby bail has been granted to similarly circumstanced co-accused, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur or the successor Court in connection with Muzaffarpur Sadar P.S. Case No. 156 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, influence the witnesses.
