The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 364A/34 of the Indian Penal Code.
The prosecution case is that the eight years old son of the informant was abducted when extortion demand of rupees of fifty thousand was made for release. It is submitted by learned counsel for the petitioners both sides are neighbours and due to the business rivalry the accusation has been levelled. Though, the victim named these petitioners in 164 Cr.P.C. statement and from
Patna High Court Cr.Misc. No.36415 of 2015 (2) dt.08-09-2015 2/2 which it transpired that the victim returned on the same day. For the occurrence of 04.04.2015 the FIR was registered on 15.05.2015 and at earlier point of time petitioner no. 1 gave sanaha with regard to the false implication and stated that the son of the informant used to disappear and come back of his own.
It is submitted by learned counsel for the informant that there is specific against the petitioners and in 164 Cr.P.C. statement the victim named these petitioners. Considering the rival submissions of the parties, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Khagaria (Muffasil) P.S. Case No. 306 of 2015 pending in the court of learned Chief Judicial Magistrate, Khagaria.
With the aforesaid observation, this application is disposed of.
