1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Raxaul Police Station Case No. 441 of 2024, dated 14.11.2024, disclosing offences under Sections 8(c)/20(b) (ii)(c)/21(b)/22(c)/29 of the Narcotic Drugs and Psychotropic Substance Act.
3. The prosecution case, as per the First Information Report, is that on 14.11.2024, at about 15:50 hrs, on secret information, the police reached near a hut at Koire Tola on Sainik road. After seeing the police party, 8-10 persons started fleeing away and on chase one of them was apprehended, who disclosed his name as Raja Hussain. Upon search, the police recovered 1.590 kg of Charas

No.40664 of 2025(2) dt.16-07-2025 2/3 (hashish) along with 32 used pieces of Onrex Cough Syrup, 22 pieces of unused Onrex Cough Syrup and brown sugar from the hut and one motorcycle and scooty from outside the hut. On inquiry, the apprehended accused persons disclosed the names of the co-accused persons, who fled away, including the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence in the manner alleged and he has falsely been implicated in the present case due to village politics. He next submits that the petitioner was not present at the place of occurrence and only on the basis of confessional statement of co-accused Raja Hussain, name of the petitioner has transpired. He further submits that no contraband article has been recovered from conscious possession of the petitioner and/or from the premises belonging to him.
5. I have heard learned counsel for the parties and have gone through the materials available on record.
6. It appears that apprehend co-accused, in his confessional statement, has disclosed the name of the petitioner as one of his accomplices. The confessional statement can be the
Patna High Court CR. MISC. No.40664 of 2025(2) dt.16-07-2025 3/3 basis of further investigation against the petitioner, which is still going on, for which, custodial interrogation may be required.
7. Taking into consideration the aforesaid and the gravity of the offence, nature of allegation and severity of punishment and the fact that recovery of narcotic substance i.e. charas (hashish) is much more than commercial quantity, I am not inclined to grant the petitioner privilege of anticipatory bail.
