Petitioner seeks bail in Araria P.S. Case No.715 of 2018 instituted for the offence under Section(s) 419, 420, 467, 468, 471 Indian Penal Code.

It is alleged in the written report that this petitioner along with Dilshad Ahmad had come to the hotel of the informant and booked Room No.105 by producing Adhaar Card in the name of Abdul Samad. Both persons left the hotel saying that they will return by 3.00 AM, but they did not return. The waiter disclosed that at the time of booking of room, one person had stated his name as Mithilesh Kumar and another as Dilshad Ahmad.

Patna High Court CR. MISC. No.38478 of 2019(2) dt.27-06-2019 2/2 In this manner, from the written report itself, it appears that name of this petitioner has been disclosed by employee of the hotel. There is no direct evidence against the petitioner.

Counsel for the petitioner further submits that coaccused, Dilshad Ahmad, has already been granted regular bail by co-ordinate Bench of this Court by order dated 15.03.2019 passed in Cr. Misc. No.16222 of 2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No.715 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
