Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case instituted under Sections 384, 387, 414, 120B of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act and 3⁄4 of the Explosive Substance Act.

The prosecution story, in brief, is that on confidential information, informant along with police force raided the out house of Ashok Baitha, from where, the petitioner was arrested from the Swift V.D.I. Maruti Car. From where 1800 pieces of Electrical Detonator had been recovered from outside of the

Patna High Court Cr.Misc. No.42304 of 2016 (2) dt.04-10-2016 2/2 house of Ashok Baitha. Thereafter seizure list was prepared in presence of the petitioner and the witnesses. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.07.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has retired from Army. He was employed as a Guard in Union Bank. The alleged recovery is said to have been made from the house of Ashok Baitha. The petitioner is separate in mess and property from the co-accused Ashok Baitha. He has no concern with the alleged recovered article.

On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas at Sasaram, in connection with Sasaram (M) P.S. Case No. 816 of 2016.
