JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 01-07-2017 Heard Sri Uday Kumar, learned advocate for the petitioner, and Sri Zainul Abedin, learned A.P.P. for the State. The petitioner is seeking regular bail in Sheohar P.S. Case No. 134 of 2016 under Sections 341, 323, 379 and 506 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that from perusal of the First Information Report itself it would appear that there is no allegation of assault though there is an allegation that the accused did not return the ornaments of the wife of the informant and, on demand, the accused threatened the informant by putting his gun on the chest of the informant. Learned counsel submits that the story, as made out in the First Information Report, looks flimsy, both the parties are neighbours and the petitioner is

Learned counsel for the petitioner further submits that earlier this petitioner was made accused in Sheohar P.S. Case No. 01/2013, however, he is acquitted in the said case. After the present case was lodged, a separate case, being Sheohar P.S. Case No. 135/2016, under the provisions of the Arms Act was lodged in which he is already granted regular bail by the court below. Considering the nature of allegations and the submissions made on behalf of the petitioner as also the period of custody, let the petitioner, namely, Lalbabu Singh be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheohar in Sheohar P.S. Case No. 134 of 2016, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
