JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after five years of marriage for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioner that petitioner is the husband of the victim and the victim committed suicide when the police was informed. Though the case was registered in 2010 but the petitioner cooperated in the investigation throughout and the investigation is still pending. It is
Patna High Court Cr.Misc. No.35104 of 2015 (2) dt.03-09-2015 2/2 further submitted that there is history of suicide in the family of victim and subsequently brother of the victim also committed suicide leading to registration of Supaul P.S. UD Case No. 17 of 2014.
Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Kadamkuan P.S. Case No. 193 of 2010 pending in the court of learned C.J.M. Patna. This application is disposed of with the aforesaid observation/direction.
