2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioner seeks bail in connection with Bisfi P.S. Case No. 410 of 2022 registered for the offence under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

4. The accused/petitioner is named in the F.I.R. and is in custody since 15.05.2023.

5. The allegation against the petitioner is to be

Patna High Court CR. MISC. No.42601 of 2023(2) dt.25-07-2023 2/3 engaged in illegal trading/manufacturing of illicit liquor, where, there is total recovery of 401.940 litres of IMFL/Country made, where recovery from the possession of petitioner alongwith other co-accused persons is 60.48 litres.

6. Learned counsel appearing on behalf of the petitioner submitted that after consideration of the fact of this case, the petitioner was granted anticipatory bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 23889 of 2023 dated 17.05.2023, but as the order was not communicated in due time, petitioner was apprehended by Police, despite order of this Court.

7. Learned APP, appears in agreement with the submission as advanced by learned counsel appearing on behalf of the petitioner as above.

8. Considering the facts and circumstances as mentioned above as petitioner was granted anticipatory bail by one of the learned co-ordinate Bench of this Court, who is now in custody since 15.05.2023, accordingly, petitioner above named, is directed to be released on bail in connection with Bisfi P.S. Case No. 410 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions
