15-02-2017 Heard Sri Gagan Deo Yadav, learned counsel for the petitioner and Sri Damodar Prasad Tiwari, learned Addl. Public Prosecutor.
This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier, by order dated 11-04-2016 passed in Cr. Misc. No. 6906 of 2016, the prayer for bail was rejected. In this case, by order dated 18-01-2017, a report was called for from the court below regarding stage of the case, which has been received and kept at flag 'X'. The report dated 27th January, 2017 sent by learned Addl. District & Sessions Judge II, Madhubani categorically indicates that out of seven chargesheeted witnesses, six have already been examined and regarding one of the remaining witness, since it was informed by the defence that
Patna High Court Cr.Misc. No.54050 of 2016 (4) dt.15-02-2017 2/2 he died, a report in this regard has been summoned. Keeping in view the fact that trial is at the fag end, there is no reason to review my earlier order. The prayer for bail again stands rejected.
However, while dismissing, it is desirable to observe that learned court below may take appropriate step so that the case may come to its logical end without unnecessary delay. (Rakesh Kumar, J.) Anay U T
