JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-07-2017 The appellant seeks regular bail in connection with Ekchari P.S.Case No. 53 of 2016, registered for offences punishable under Section 363,365,376 (D) & 328 of the Indian Penal Code and Section 3(1)(xi) of SC/ST (POA) Act. Submission of the learned counsel for the appellant is that she has been falsely implicated in this case and apart from that there is no allegation of either commission of rape or administering any liquor making her unconscious against this lady and at best the allegation is that she went along with the other accused persons at Delhi and when the occurrence took place, in order to save herself, she named the appellant and other accused persons. The appellant is in custody for more than six months. Heard learned Special P.P.
Patna High Court CR. APP (SJ) No.1368 of 2017 (3) dt.01-07-2017 2/2 Having heard both sides and in view of allegation, I am not inclined to grant bail to the appellant at this stage, however, the learned trial court is directed to expedite the trial of the appellant and try to conclude it within a period of six months and if not concluded, the appellant is at liberty to renew her prayer for bail.
Accordingly, this appeal is dismissed.
