The petitioner seeks bail in Jogbani P.S. Case No. 115/2019, instituted for offence under Section(s) 414/34 of the Indian Penal Code read with Sections 27(b)(ii), 28 R/W 36 of Drugs and Cosmetics Act.

It is alleged in the written report that on getting secret information, the informant along with other S.S.B. personnel searched the motorcycle of petitioner coming from Forbesganj and recovered 108 pcs, each containing 2ml of Daizelab injection, Titrosan medicine10-180pcs. and Nepali cash of Rs. 22,000/-.

Learned counsel for the petitioner has submitted that petitioner is working in Nepal. On the date of occurrence

No.37891 of 2019(2) dt.26-06-2019 2/2 petitioner had visited Forbesganj for the work of his company and met his co-villager Bhola, who handed over the alleged recovered medicines and requested the petitioner to give the same in his house. Petitioner had no knowledge about carrying of such medicines is prohibited.

Petitioner is in custody since 13.04.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st , Araria, in connection with Jogbani P.S. Case No. 115/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
