2 The petitioner apprehends his arrest in connection with Complaint Case No 347 of 2019 for the offence under Sections 498A, 323, 504, 506 of the Indian Penal Code. 3 As per the complaint case, the allegation against the petitioner is that he has tortured the complainant and driven her out from the house after snatching her articles. 4 Learned counsel for the petitioner submits that the complainant was maid servant of the petitioner who falsely claimed her marriage with the petitioner in 2017 against which the petitioner moved the Family Court at Bhojpur, Ara and vide

Patna High Court CR. MISC. No.41533 of 2023(2) dt.02-08-2023 2/2 judgment dated 10.08.2022 in Matrimonial Case No 10 of 2020, the alleged marriage was declared as null and void and the complainant has filed the complaint case with a motive to extort money from the petitioner. Petitioner is aged about 75 years having no criminal antecedent.

5 Learned APP opposes the prayer for anticipatory bail.

6 Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to each to the satisfaction of the Judicial Magistrate, 01st Class, Patna City Court, Patna in connection with Complaint Case No 347 of 2019, subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
