2. The petitioner seeks regular bail in connection with Manjhaulia P.S. Case No. 677 of 2024 registered for the offence under Sections 137(2), 96, 352/3(5) of the Bharatiya Nyaya Sanhita, 2023. Subsequently, added Section 8 of the POCSO Act.
3. Though the allegation against the petitioner is of kidnapping the victim girl but from the statement of the victim girl it appears that she had eloped with the petitioner and got married to him.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.39124 of 2025(2) dt.25-06-2025 2/2 petitioner is innocent and has not committed any offence. The petitioner is in custody since 09.04.2025.
5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, West Champaran at Bettiah in connection with Majhaulia P.S. Case No. 677 of 2024.
