JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Dhamdaha P.S. Case No. 72 of 2018, registered for offences punishable under Sections 304(B) and 34 of the Indian Penal Code.

Allegation against the petitioner and others is of causing dowry death of the deceased.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner and he is the villager of the deceased and had no concern with the husband and other family members of the deceased. Further he has been in judicial custody since 29.05.2018. Heard learned A.P.P. also and perused the F.S.L. report from which, it appears that Celphos was found in the

Patna High Court Cr.Misc. No.48535 of 2018(7) dt.21-12-2018 2/2 Viscera.

Having heard both sides, considering the facts and circumstances of the case and also the fact that petitioner is not the member of family of the deceased and happens to be the villager only, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S. Case No. 72 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
