NILU AGRAWAL ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody since 20.03.2017 in connection with Tarapur P.S. Case No. 121/16, for offences punishable under Section 379 of the Indian Penal Code. Informant lodged the case against unknown for theft of his motorcycle from his house.

It has been submitted by the learned counsel for the petitioner that he is innocent, is in custody since 20.03.2017 and another co-accused has since been granted the privilege of bail by a Coordinate Bench of this court in Cr. Misc. No. 12134 of 2017 on 18.03.2017. He submits that the confessional statement of co-accused Niraj Kumar, Sonu @ Sonu Singh has no evidentiary

Patna High Court Cr.Misc. No.22939 of 2017 (3) dt.23-06-2017 2/2 value in the eye of law and that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IV, Munger, in connection with Tarapur P.S. Case No. 121/2016.
