The petitioner seeks bail in Araria (Mahila) P.S. Case No. 29/2019, instituted for offence under Section(s) 376 of the Indian Penal Code.
Learned counsel for petitioner has submitted that petitioner has been falsely implicated in this case due to family dispute. Compromise has taken place between the parties. It is alleged in the written report that on the date of occurrence at 11.20 P.M. informant and his family members were sleeping in their rooms. At that time informant went for natural call and saw his daughter-in-law also came out from the room. Thereafter informant heard some noise from the room of his daughter-in-law and went back on bed. In the meantime informant heard sound of cry of his daughter-in-law. He went to

Thereafter his daughter-in-law informed that when she had gone to attend call of nature petitioner entered into her room and when she returned, petitioner committed illegal act with her. It is alleged that informant kept confined the petitioner whole night and handed over to the Tarabari police in the morning.
Learned counsel for petitioner has submitted that F.I.R. has been lodged in Mahila P.S. for the alleged occurrence. Learned counsel for informant has submitted that compromise has taken place between the parties. Petitioner is in custody since 06.04.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria, in connection with Araria (Mahila) P.S. Case No. 29/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
