====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-06-2026 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application with regard to petitioner nos. 1 and 3.

2. Permission is granted.

3. This anticipatory bail application with regard to petitioner nos. 1 and 3 is, accordingly, dismissed as withdrawn.

4. Heard learned counsel for the petitioners and the State.

5. Petitioner nos. 2 and 4 apprehend arrest in a case registered for the offences punishable under Sections 126(2),

Patna High Court CR. MISC. No.40374 of 2026(2) dt.30-06-2026 2/3 115(2), 109(1), 303(2), 352, 351(2), 3(5) and 308(3) of the Bharatiya Nyaya Sanhita.

6. As per prosecution case, on 03.09.2025 at about 07:30 PM, all the F.I.R. named accused persons, including these petitioners assaulted the husband of informant by means of knife, butt of gun. It is further alleged that the accused persons snatched Rs. 7,000/- from the pocket of the husband of the informant and threatened informant with dire consequences.

7. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Specific accusation of assault is against other accused persons. So far these petitioners are concerned there is no allegation of any specific overt act against them. Rest of the allegations are ornamental only to make the case grave. Case and counter case. Petitioner no. 2 claims clean antecedent and petitioner no. 4 has got one criminal antecedent in which he is on bail.

8. Learned A.P.P. for the State vehemently opposed the bail application.

9. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners nos. 2 and 4 in the event of their arrest/surrender before the court below within a period of eight

Patna High Court CR. MISC. No.40374 of 2026(2) dt.30-06-2026 3/3 weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P. S. Case No. 243 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

10. This anticipatory bail application, accordingly, stands disposed of.
