JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-01-2015 Despite repeated calls, nobody appears on behalf of the petitioner to press this application which has been filed questioning his transfer vide order as contained in Annexure 1/1 as Medical Officer from Primary Health Centre Jhajha to the post of Deputy Superintendent, Sadar Hospital, Mozaffarpur. The petitioner has also called in question the order dated 09.10.2010 (Annexure-1) whereby he was relieved from Jamui in the light of the notification of the government.
It has been pointed out by the counsel for the State that the transfer order was a chain transfer of several doctors. The petitioner continued to defy the said order inasmuch as has already been suspended and a proceeding has been initiated vide
Patna High Court CWJC No.19586 of 2010 (3) dt.22-01-2015 2 / 2 resolution dated 09.12.2010 (Annexure A to the counter affidavit). In his submission the application has become infructuous. Be that as it may, since nobody has appeared on behalf of the petitioner to press this application, this Court is constrained to dismiss the application for non prosecution. I order accordingly.
