No one appears for the State.

The petitioner is seeking regular bail in Matihani P.S. Case No. 3 of 2017 under Section 30(a) of the Bihar Excise and Prohibition Act, 2016.

Learned counsel for the petitioner submits that from perusal of the First Information Report it would appear that as many as eight persons have been made accused on the allegation that liquor was recovered from the backyard of the house of Shivan Singh and Mohan Singh. In the First Information Report, save and except that there are allegations of suspicion nothing else is against the petitioner. Learned counsel for the petitioner submits that the seizure is not from his house or from his conscious

Patna High Court Cr.Misc. No.27472 of 2017 (2) dt.01-07-2017 2/2 possession. The petitioner is in custody since 15.02.2017 despite having no criminal antecedent, as stated in Paragraph 3 of the application.

Considering the facts and circumstances of the case, let the petitioner, namely, Barsha Rai be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri S. Oraon, A.C.J.M. VI, Begusarai in Matihani P.S. Case No. 3 of 2017, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
