The petitioners seek bail in Khizersarai P.S. Case No. 81/2009, instituted for offence under Section(s) 147, 148, 149, 341, 323, 448 and 364 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for petitioners has submitted that petitioners are not named in the written report. There is no allegation of specific overt act against these petitioners. Three accused persons are named in the written report. Name of these petitioners has come during investigation in the supplementary case diary.

Patna High Court CR. MISC. No.39818 of 2019(4) dt.28-08-2019 2/2 The other co-accused has already been granted bail by a Co-ordinate Bench of this Court vide order dated 22.11.2012 passed in Cr. Misc. No. 35097/2012.

Petitioners are in custody since 26.02.2019 and 18.02.2019 respectively.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Khizersarai P.S. Case No. 81/2009, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
