Mr. Shahabuddin Azeem @ S. Azeem, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that villagers informed during search of his daughter who was missing that they have seen her on a motorcycle with Anoj and Arvind, further alleges that he went to house of Anoj where his mother said that she will talk to her son for returning his daughter and when he went to the house of Arvind he along with his father (petitioner) said that Anoj had kidnapped your daughter and were also ready to assault him, it is next alleged

Patna High Court CR. MISC. No.41649 of 2022(2) dt.12-12-2022 2/3 that he came to know that Anoj with his daughter had gone to Surat for a day and fled from there, thus alleges that accused persons kidnapped his daughter.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that the victim was in love with Anoj and she eloped with him, it is also submitted that the date of occurrence is 16.03.2022 and the FIR was instituted on 01.04.2022 i.e., after a delay of 15 days without any plausible explanation, it is next submitted that petitioner came to be implicated in the present case merely because he is father of Arvind, who is friend of Anoj, though no specific allegation has been alleged against him, it is next submitted that even the victim has returned and her statement was recorded under Section 164 Cr.P.C. The learned counsel for the petitioner next submits that whenever such occurrence takes place the entire family members of the accused along with his friends and relatives are also implicated. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court

Patna High Court CR. MISC. No.41649 of 2022(2) dt.12-12-2022 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Halsi P.S. Case No. 89 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
