JUSTICE RAKESH KUMAR ORAL ORDER 20-10-2016 Heard Dr. Shraddhanand Paswan, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner who is in custody since 6.6.2016 in Phulwarisharif P.S. Case No. 313 of 2016 registered for the offence under Section 399, 402 of the Indian Penal Code , Section 25 (1-b) a/ 26/ 35 of the Arms Act has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on false accusation of recovery of one loaded country made pistol with one live cartridge and one key ring the petitioner has been detained and petitioner is having clean antecedent which fact has been stated in paragraph no. 3 of the petition.

No.43127 of 2016 (2) dt.20-10-2016 2/2 Keeping in view the nature of accusation, period of custody and clean antecedent of the petitioner let the petitioner Harun Kumar @ Banti be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Ms. Shema Eram, Judicial Magistrate 1st Class, Patna / concerned court in connection with Phulwarisharif P.S.
