This application for grant of anticipatory bail arises out of Rohtas Complaint Case No. 615 of 2018, disclosing offences under Sections 498A, 323, 406, 504/34 of the Indian Penal Code and Section 3⁄4 of D.P. Act.

The petitioner is the husband of the complainant. It appears that the matter was referred to Patna High Court Mediation Center by an order dated 11.09.2019, for amicable resolution of dispute. The petitioner was granted interim protection by the said order.

The report of the learned mediator is there on record from which it appears that the dispute could not be resolved

On perusal of the complaint, it appears that the matrimonial dispute between the petitioner and the complainant is one of the main reasons for lodging of the criminal case. Considering the facts and circumstances, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Sasaram, Rohtas in connection with Complaint Case No. 615 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
