JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-07-2021 As prayed for, through video conferencing, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide it's note, dated 22.12.2020, within four weeks of starting of the Court proceeding in physical mode properly.

Heard the parties through video conferencing. The petitioner seeks pre-arrest bail in connection with Bhagwanpur P.S. Case No. 177 of 2019, registered under Sections 427, 386 and 387/34 of the Indian Penal Code. The accusation is that on 20.07.2019 the damaged boundary wall of R.P.L. Limited Company was being erected in village Bithauli, P.S. Bhagwanpur, district Vaishali, at that time, the land owner Ajay Singh, along with his sons, Banti and Bablu Kumar (petitioner), and some unknown started quarrel and scuffle at the main gate of factory and they demanded ransom of rupees five lakh to erect the boundary. On protest they all started destructing the boundary wall, which was under construction.

No.38899 of 2020(2) dt.09-07-2021 2/2 Learned counsel appearing for the petitioner submits that in fact, the Company, named in the first information report, had purchased the land of family of the petitioner, but, at the time of creating the boundary wall the Company started to erect the boundary encroaching the land of the petitioner due to which exchange of hot word took place, but, with ulterior motive, the informant lodged the present case.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of arrest/surrender, within a period of four weeks from today, in connection with Bhagwanpur P.S. Case No. 177 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, I, Vaishali at Hajipur, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
