Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)a, 26 of the Arms Act.

The prosecution case is that on information that miscreants are preparing to commit dacoity, raid was led when one person was apprehended who disclosed the name of others including the petitioner who escaped from the scene. It is submitted by learned counsel for the petitioner that except confession of the co-accused, there is nothing collecting during investigation against the petitioner and admittedly there is no recovery from the petitioner. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.37510 of 2015 (2) dt.17-09-2015 2/2 consideration of regular bail, if the petitioner surrenders within a period of six weeks in connection with Dariyapur P.S. Case No. 212 of 2014, pending in the Court of learned Chief Judicial Magistrate, Saran at Chapra.

With the observations above, the application stands disposed off.
