The petitioner apprehends his arrest in Muffasil P.S. case No. 112 of 2016 under Section 324, 379 and other Sections of the Indian Penal Code but later on by order dated 12.04.2016 Section 307 of the IPC was added.
The informant alleged that Nagendra Yadav pushed her and assaulted her with back of spade. Ram Naresh Yadav assaulted with Farsa on her head. Usha Devi snatched her golden nose pin. The informant named the petitioner along with other accused persons and alleged that when her son and daughter came to save her, the accused persons also assaulted them. It is submitted that there is omnibus and general allegation against the petitioner of assaulting son and daughter of
Patna High Court Cr.Misc. No.40007 of 2016 (2) dt.22-09-2016 2/2 the informant but the daughter of the informant did not receive any injury. The son of the informant got one abrasion, which is simple in nature.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Siwan Muffasil P.S. Case No. 112 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
