The petitioner seeks bail in a case registered under Section 307 of the Indian Penal Code and 27 of the Arms Act. The allegation is that counter firings were going on between Sikandar Khand and Sunil Kumar and two empty cartridges are recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.4.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. None is said to have been injured in course of occurrence. Hence, no offence under Section 307 of the I.P.C. is made out.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Rafiganj P.S. case No.139 of 2018.
