This is an application for bail in connection with Maheshkhunt P.S.Case No. 17 of 2017 registered for the offences punishable under Sections 307/34 of the Indian Penal Code. Petitioner is not named in the FIR and later on in course of investigation his name transpires.

It has been submitted on behalf of the petitioner that petitioner is not named and even in the statement of informant he has not named this petitioner as assailant, rather he was driving motorcycle and pillion rider shot fire at the son of informant causing injury on him and further he is in custody for four months. Heard learned APP also.

Having heard both sides and in view of the fact that

Patna High Court Cr.Misc. No.31818 of 2017 (3) dt.21-07-2017 2/2 though petitioner is not assailant but he was driving motorcycle and pillion rider fired shot causing injury on son of the informant, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude it within nine months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.

With the above observation, this application is dismissed.
