The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 307, 120B/34 of the Indian Penal Code and 27 of the Arms Act. The prosecution case is that co-accused Nepali Yadav, Pramod Yadav, Upendra Yadav, this petitioner and three unknown intercepted the informant and his companion Sakendra Yadav and Uday Yadav and resorted to indiscriminate firing as a result both the companions of the informant died at the spot.

Patna High Court Cr.Misc. No.34585 of 2015 (2) dt.25-08-2015 2/2 been granted regular bail vide Cr. Misc. No. 32322 of 2011. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

In the circumstances, this application is disposed of.

It is expected from the learned court below to consider the prayer for regular bail of the petitioner keeping in view of the fact that similarly situated co-accused has been granted regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sessions Trial No. 69A of 2012 arising out of Chandradeep P.S.
