JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioner is not named in the first information report but his name surfaced in this case in course of investigation and accordingly, he was remanded in this case and confessed his guilt. Para-34 of the case diary goes to show that one motorcycle was recovered from the field.

Submission on behalf of the petitioner is that neither petitioner was identified by the witnesses nor the stolen motorcycle has been recovered from his conscious possession. Considering the aforesaid facts and circumstances as

No.44744 of 2016 (3) dt.29-11-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Rosera, Samastipur in connection with Singhia P.S. Case No. 49 of 2016.
