====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 27-08-2018 Heard learned counsel for petitioner and learned counsel for the State.
Petitioner, who is in custody, seeks bail in connection with Sahpur P.S. Case No. 116 of 2018 registered for the offences punishable under Sections 413, 420, 467, 468 and 471 of the Indian Penal Code.
Allegation against petitioner is being caught by the police on stolen motorcycle.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. He has no criminal antecedent and he is in custody since 02.05.2018. It has been further submitted that similarly placed co-accused, namely, Ranjeet Kumar and Prabhat Pandey have
Patna High Court Cr.Misc. No.49293 of 2018(3) dt.27-08-2018 2/2 been granted bail by this court and co-ordinate Bench of this court in Cr. Misc. No. 45669 of 2018 and Cr. Misc. No. 44202 of 2018 vide order dated 27.07.2018 and 31.07.2018 respectively.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara at Bhojpur in connection Sahpur P.S. Case No. 116 of 2018.
