1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Bhargama P.S. Case No. 223 of 2019 registered under Section 307 and other allied sections of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that similarly situated co-accused has already been allowed bail by this Court vide order dated 20.12.2021 passed in Cr. Misc. No. 15652 of 2021, as contained in Annexure-2 to the bail application.

4. Having considered the facts and circumstances of

No.43095 of 2023(2) dt.04-08-2023 2/2 the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial MagistrateI, Araria in connection with Bhargama P.S. Case No. 223 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
