2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 408 and 409 of the Indian Penal Code.
3. As per the prosecution case, petitioner, Panchayat Secretary of Chhitahi Gram Panchayat along with Mukhia of the said Panchayat jointly issued cheque in favour of Ward member and Ward Secretary, who allegedly misappropriated Government money without completing work entrusted under the Government scheme.
4. Learned counsel appearing for the petitioner submits that petitioner has not been named in the FIR rather his name has come in the case during course of investigation. However, supplementary affidavit has been filed by the petitioner. In paragraph 3 of the same, petitioner has stated that
Patna High Court CR. MISC. No.44158 of 2025(3) dt.08-09-2025 2/2 he has already deposited entire amount of Rs.11,57,600/- in the bank account of Gram Panchayat, Supaul in different instalments. Photo stat copies of receipts/challans are contained in annexure P/2 to the supplementary affidavit. Petitioner has already superannuated from service. Petitioner claims clean antecedent.
5. Considering the averment of the petitioner made in the supplementary affidavit, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in Bhaptiyahi Police Station Case No. 120 of 2023, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
