Petitioner is in custody since 05.10.2016 in connection with Barari P.S. Case No. 144 of 2016 registered under Sections 302, 201, 379, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
Accusation is of murder.
Learned counsel for the petitioner has submitted that the petitioner has been implicated in this case merely on the ground of suspicion and without any cogent reason. Though this petitioner along with co-accused, Ashok Choudhary, has been named in the F.I.R. but the co-accused, Ashok Choudhary has already been regular bail by the lower court in Bail Application No. 1515 of 2016. The petitioner is rotting in jail custody for the last three and half months.

No.54084 of 2016 (4) dt.20-02-2017 Considering the facts and circumstances of the case and the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Katihar in connection with Barari P.S. Case No. 144 of 2016.
