The petitioner has preferred this application for grant of regular bail in a case registered under sections 120B, 121A, 122 and 123 of the Indian Penal Code, sections 25(1-B)(a) and 26 of the Arms Act and sections 16, 18, 20 and 21 of the U.A.P. Act.

As per the prosecution case, on the police personnel raiding the house of one Vikash Kumar Rajak, it is stated that a loaded country-made pistol as also other articles were recovered and from the interrogation he disclosed that he was conducting naxal activities in the district. The name of the other accused persons including this petitioner transpired in the statement of said Vikash Kumar Rajak.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.50528 of 2021(2) dt.23-02-2022 2/2 that no incriminating article has been recovered from the petitioner's possession who is in custody since 15.12.2020 and investigation in the case has concluded. The said Vikas Kumar Rajak has been enlarged on bail vide order dated 7.12.2020 (Annexure-2).

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner being in custody for more than 1 year and grant of bail to Vikas Kumar Rajak on whose confessional statement before the police the name of the petitioner transpired, the petitioner is directed to be enlarged on bail in connection with Motipur P.S. Case no. 519 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge - cum - Special Judge, Muzaffarpur.
