Heard learned counsel for the parties concerned. 2.

The present petition has been filed for modification of the order dated 16.08.2023, passed by this Court in Cr. Misc. no. 49710 of 2023.

Learned counsel for the petitioner submits that vide aforesaid order, the petitioner was directed to surrender before the learned court below within a period of four weeks from the date of order but due to communication gap, he could not surrender within time and could not furnish the bail bonds, as directed by this Court.

Having regard to the facts and circumstances of the

Patna High Court CR. MISC. No.48610 of 2024(2) dt.12-07-2024 2/2 case, considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made in the present petition, order dated 16.08.2023, passed by this Court in Cr. Misc. no. 49710 of 2023 is modified and now, the petitioner is directed to surrender before the learned Judicial Magistrate-1st class, Samastipur within a period of two weeks from today, subject to deposit of a sum of Rs. 2,000/- before the District Legal Services Authority, Samastipur. 5.

The present petition stands allowed with the aforesaid modifications.
