The petitioner seeks bail in Daraunda (M.H. Nagar) P.S. Case No. 29 of 1999, registered under Sections 414, 307 and other sections of the I.P.C. and different sections of Arms Act. The A.S.I. of M.H. Nagar P.S. alleged that a counter was held in which firing and cross firing was made. On chase, one Brahma Singh was apprehended and from his possession arms and ammunitions recovered.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner has been surfaced in the confessional statement of Brahma Singh recorded in para 4 of the case diary. Save and except confession of Brahma Singh, the Police did not collect any tangible material against the petitioner. The petitioner is in jail since 09.03.2016. The petitioner has already in jail for more than eight months.
